1. Who We Are

SimSwan ("the Application", "we", "us") is operated by AY, an individual developer trading as SimSwan ("the developer"). A company may be registered in the future, and these Terms will be updated if the operating entity changes.

2. Educational & Analytical Use Only

SimSwan provides quantitative models, options payoff charts, portfolio analytics, and numerical estimations based on mathematical constructs such as the Black-Scholes model. All outputs, calculations, probabilities, and Greek estimates are provided as analytical and illustrative tools for research and educational use. They are not guarantees of future results.

3. No Financial Advice

Nothing within the Application constitutes a solicitation, recommendation, endorsement, or offer to buy or sell securities, options, derivatives, or any financial instrument. The developer is not a registered investment adviser, broker-dealer, or financial analyst. You remain solely responsible for your own financial decisions.

4. Eligibility

You must be at least 18 years of age to use the Application. By using it, you confirm that you meet this requirement and that you have the legal capacity to enter into these Terms.

5. Accounts

• You must provide accurate information when creating an account and keep your email address up to date.
• You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
• You must notify us promptly at support@simswan.com if you suspect unauthorised access to your account.
• We may suspend or terminate accounts that breach these Terms, abuse the service, or attempt to compromise its security.

6. Cloud Storage and Sync

SimSwan stores account and portfolio data in secure cloud infrastructure so your data is available across devices. You are responsible for the accuracy and legality of the data you enter, upload, or sync. Portfolio data is processed and stored as described in our Privacy Policy. You can export and delete your account data as set out in that policy.

7. Subscriptions, Billing, and Refunds

Paid features, where offered, are purchased through Google Play Billing. Payment, renewal, cancellation, and refunds are handled by Google under the Google Play Terms of Service and refund policy. We do not process or store your payment card details. Any free trial or introductory pricing, where offered, is subject to the terms presented at the point of purchase.

8. Acceptable Use

You agree not to misuse the Application, including by attempting to access other users' data, reverse-engineering security controls, scraping at scale, or using the Application for unlawful purposes.

9. Assumption of Risk & Limitation of Liability

Financial markets carry inherent risks, and actual market pricing may deviate substantially from theoretical models due to slippage, liquidity constraints, transaction costs, dynamic volatility skews, and dividend assignments.

To the fullest extent permitted by law, under no circumstances shall the developer or contributors of SimSwan be held liable for any direct, indirect, incidental, punitive, or consequential damages, including but not limited to real-world trading losses, capital depreciation, or lost profits resulting from your reliance on or use of this Application. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

10. "As Is" Warranty Disclaimer

The Application is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including accuracy, reliability, completeness, or fitness for a particular purpose. We do not warrant that the Application will be uninterrupted, error-free, or that market data will always be accurate or available.

11. Intellectual Property

The Application, its code, models, design, and content are owned by the developer and protected by applicable intellectual property laws. These Terms grant you a personal, non-transferable, non-exclusive licence to use the Application. You retain ownership of the data you enter.

12. Account Deletion

You may delete your account and associated data at any time from within the Application, or by contacting support@simswan.com. Deletion is permanent and cannot be undone.

13. Changes to These Terms

We may update these Terms as the Application evolves. The "Last updated" date above reflects the current version. Continued use of the Application after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales, and any disputes arising from them are subject to the exclusive jurisdiction of the courts of England and Wales.

15. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. These Terms and the Privacy Policy constitute the entire agreement between you and the developer regarding the Application.

16. Acceptance of Terms

By downloading, installing, accessing, or using SimSwan, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions.
